I think this is a great idea and deserves looking into further! Before you say "a pirate would say that" let me explain a little more.
At present if I wants goods that I can only get in high sec, I have to get them delivered because I can't enter. Meaning I can sit safely away somewhere in low-sec and having my shopping done for me. It's a bit like tesco.com, nice if you want to pay the delivery charge.
Lets just suppose I could pop into Jita and get those things myself WITHOUT Concord or the faction navy blasting me to atoms within 2 seconds of jumping into the system.... I head through Caldari space and through numerous systems where I _could_ be attacked by anyone who fancied their chances.
I on the otherhand could _not_ shoot at innocent people. If I did, I would be instapopped by our all powerful overlords.
I can be attacked, and if I am I have the right to defend myself against the person attacking me. Ie, they have fired at me in an attempt to pop me, therefore I can defend myself (If they had not have done so, we'd both be on our merry ways still).
Lets suppose I bring a friend along for the ride... I get tackled and attacked. Myself and my agressor start shooting and I'm losing. My friend remote reps me - however they've assissted a criminal and that means... Concordokken!
I like this because;
I can enter high sec (just not shoot anyone without being Concorded)
People can attack me in high sec (without fear of Concord)
Concord won't attack me if I behave
I can fight back if someone attacks me
However, even with these changes I don't know if I'd still bother going all the way there myself. After all, it's possible I could get ganked by the all power State War Academy Ibis fleet 
The consequence to this might be that _less_ anti pirates come blobbing around low-sec and sit in high sec. Which suits me fine.
Interesting idea, and without thinking too much into it, I quite like it. But me being me, I've probably missed something very fundamental and shot myself in the foot... nevermind, ho hum...
